Algemene Voorwaarden (NL)

Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen, overeenkomsten en leveringen van Fairway Hands, een eenmanszaak gevestigd te Duinvallei 12, 2553 AB Den Haag, Nederland.

1. Definities

  • Ondernemer: Fairway Hands.

  • Klant: iedere natuurlijke of rechtspersoon die een overeenkomst aangaat met Fairway Hands.

  • Consument: een natuurlijke persoon die handelt voor doeleinden buiten zijn bedrijfs- of beroepsactiviteit.

  • Overeenkomst: iedere overeenkomst tussen Fairway Hands en de klant.

2. Toepasselijkheid

Deze voorwaarden zijn van toepassing op alle verkopen via de webshop, Shopify-platform, en overige online kanalen. Bij verkoop via derden (zoals Bol.com of fysieke winkels) kunnen aanvullende of afwijkende voorwaarden gelden.

3. Aanbod en overeenkomst

Alle aanbiedingen zijn vrijblijvend. Een overeenkomst komt tot stand zodra Fairway Hands een bestelling bevestigt of deze feitelijk uitvoert.

4. Prijzen en betaling

Alle prijzen zijn inclusief btw voor consumenten, tenzij anders vermeld. Betaling kan plaatsvinden via Mollie, waaronder iDEAL en creditcard. Fairway Hands behoudt zich het recht voor prijzen te wijzigen.

Bij zakelijke klanten is Fairway Hands gerechtigd wettelijke handelsrente en redelijke incassokosten in rekening te brengen bij niet-tijdige betaling.

5. Levering

Levering vindt plaats binnen de Europese Unie. Opgegeven levertijden zijn indicatief en niet fataal. Overschrijding van levertijden geeft geen recht op schadevergoeding of ontbinding.

6. Eigendomsvoorbehoud

Alle geleverde producten blijven eigendom van Fairway Hands totdat volledige betaling heeft plaatsgevonden.

7. Herroepingsrecht

Voor consumenten geldt een herroepingsrecht van 30 dagen overeenkomstig het retour- en terugbetalingsbeleid van Fairway Hands.

8. Garantie

Op alle producten is uitsluitend de wettelijke garantie van toepassing. Fairway Hands geeft geen aanvullende commerciële garanties.

9. Aansprakelijkheid

De aansprakelijkheid van Fairway Hands is beperkt tot het bedrag van de factuur waarop de aansprakelijkheid betrekking heeft, tenzij sprake is van opzet of grove nalatigheid.

10. Overmacht

Fairway Hands is niet aansprakelijk voor tekortkomingen als gevolg van overmacht, waaronder logistieke problemen, pandemieën, stakingen, IT-storingen of andere omstandigheden buiten haar macht.

11. Accounts en gebruik

Klanten zijn verantwoordelijk voor correct en veilig gebruik van hun account. Fairway Hands behoudt zich het recht voor accounts te beëindigen bij misbruik of schending van deze voorwaarden.

12. Intellectueel eigendom

Alle intellectuele eigendomsrechten met betrekking tot de webshop, producten, content en materialen berusten bij Fairway Hands.

13. Wijziging voorwaarden

Fairway Hands behoudt zich het recht voor deze voorwaarden eenzijdig te wijzigen. De meest actuele versie is steeds van toepassing.

14. Toepasselijk recht en geschillen

Op alle overeenkomsten is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter te Den Haag.

These Terms and Conditions apply to all offers, orders, agreements and deliveries of Fairway Hands, a sole proprietorship established at Duinvallei 12, 2553 AB The Hague, The Netherlands.

1. Definitions

  • Entrepreneur: Fairway Hands.

  • Customer: any natural or legal person entering into an agreement with Fairway Hands.

  • Consumer: a natural person acting outside a business or professional capacity.

  • Agreement: any agreement between Fairway Hands and the customer.

2. Applicability

These terms apply to all sales via the webshop, Shopify platform and other online channels. For sales via third parties (such as Bol.com or physical stores), different terms may apply.

3. Offers and agreement

All offers are non-binding. An agreement is concluded once Fairway Hands confirms an order or performs it.

4. Prices and payment

All prices are inclusive of VAT for consumers, unless stated otherwise. Payment is processed via Mollie, including iDEAL and credit card options. Fairway Hands reserves the right to change prices.

For business customers, statutory commercial interest and collection costs may be charged in case of late payment.

5. Delivery

Delivery takes place within the European Union. Delivery times are indicative and not binding. Delay does not entitle the customer to compensation or termination.

6. Retention of title

All delivered products remain the property of Fairway Hands until full payment has been received.

7. Right of withdrawal

Consumers have a right of withdrawal of 30 days in accordance with the return and refund policy of Fairway Hands.

8. Warranty

Only statutory warranty applies. No additional commercial warranties are provided.

9. Liability

The liability of Fairway Hands is limited to the invoice amount related to the liability, except in cases of intent or gross negligence.

10. Force majeure

Fairway Hands shall not be liable for failure to perform due to force majeure, including logistical issues, pandemics, strikes, IT failures or circumstances beyond its control.

11. Accounts and use

Customers are responsible for secure use of their accounts. Fairway Hands may terminate accounts in case of misuse or violation of these terms.

12. Intellectual property

All intellectual property rights related to the webshop, products and content belong to Fairway Hands.

13. Amendments

Fairway Hands reserves the right to amend these terms unilaterally. The most current version shall always apply.

14. Governing law and jurisdiction

All agreements are governed by Dutch law. Any disputes shall be submitted to the competent court in The Hague.
